    Although you may have had a blood alcohol concentration under the legal limit this does not guarantee that they do not have enough evidence to charge you with DUI. If they can prove your driving was impaired, you can be charged with a DUI. Unfortunately, without more information about the evidence they have against you it's impossible to say how strong the state's case is against you.
