    Why was I arrested if I can handle my alcohol?

    Was it legal for them to charge me with DUI if I can handle my alcohol?

    If your blood alcohol concentration is 0.08% or higher it won't matter if you can "handle your alcohol" they can charge with a DUI. If your BAC is below the legal limit and they don't have any evidence that your driving was impaired, it will be tough for the state to prove their case.
