    DWI after devastating accident

    I was on a trip to Paducah KY and rolled my vehicle at mm 98.4 that caused me to suffer a life threatening injury. I was almost dead when help arrived. They are trying to give me a DWI that is based on a blood test that was performed over 45 minutes after they started emergency treatment/surgery.

    In many states if you are unconscious or you fail to voluntarily submit to a blood or breath test, a police officer can get a search warrant and forcibly take your blood. Prior to a forced blood withdrawal the police may have to meet specific requirements, for instance, the state may require that you be under arrest or they have obtained a search warrant.

    Talk to an experienced defense attorney who knows the chemical testing statutes in your state and can determine whether warrants and forcible blood draws are required or permitted. If you completed the evaluation form a DUI lawyer should contact you within a few days to discuss your case.
